Terms and Conditions

These terms explain the rules for using our website and learning resources, and how they relate to participation in Fractal Accelerator.
1. About these terms
Fractal Accelerator is operated by General Fractal Corporation. In these terms, “Fractal Accelerator,” “we,” “us,” and “our” refer to General Fractal Corporation. “You” means the person using our website, student portal, or learning resources, or participating in our program.
By using these services, you agree to these terms to the extent permitted by applicable law. If you do not agree, please do not use the services. You must have the legal capacity to enter into an agreement, or the involvement and consent of a parent or legal guardian where required.
A separate written enrollment agreement or other agreement we enter into with you controls if it conflicts with these terms on the same subject. These terms do not reduce any mandatory consumer rights or any refund promise made to you when you enrolled.
2. Applications and enrollment
Please provide accurate, current information when applying or communicating with us. Submitting an application or scheduling a call does not by itself guarantee admission or reserve a place. Your enrollment confirmation and any applicable written agreement describe your cohort, fees, payment arrangements, and included services.
You are responsible for meeting the requirements communicated for your cohort, including access to a suitable computer and any required third-party tools. Additional tool subscriptions or usage charges are your responsibility when disclosed as separate from tuition.
3. Payments, cancellations, and refunds
Review the price and payment terms provided to you before paying. Payments made through Stripe are also subject to the payment provider’s applicable terms.
Our program offers a full tuition refund up to two weeks into the program, as stated on our payment page. To request a refund, email admin@fractalnyc.com within that period with your name and cohort. This page does not shorten that refund window or add an attendance requirement.
For requests outside that window, deferrals, or other payment questions, contact us. Any additional rights under your enrollment agreement or applicable law still apply. Charges paid directly to third-party providers are governed by their refund policies.
If we cancel a program or materially change its schedule or format, we will contact affected participants about available options and any refund rights under their enrollment terms and applicable law. These terms do not authorize us to retain payments for services we are legally required to refund.
4. Educational services and AI tools
Fractal Accelerator provides education and practice with AI and related tools. We may update teaching materials, exercises, tools, and instructors as technology and learning needs change, subject to our commitments to enrolled participants.
Learning and career outcomes depend on your circumstances, effort, and other factors. We do not guarantee employment, a promotion, income, funding, business results, or a particular level of proficiency. Examples and participant experiences are illustrative, not promises of your results.
AI-generated outputs can be inaccurate, incomplete, biased, or insecure. Review and test outputs before relying on them, especially before deploying code or taking actions that affect other people, accounts, or data. Course content is not individualized legal, medical, financial, or other professional advice.
5. Responsible use and community conduct
Use our services lawfully and treat participants, instructors, and staff respectfully. Follow reasonable safety, campus-access, and community rules communicated to you.
- Do not harass, threaten, discriminate against, or impersonate others.
- Do not access systems or data without authorization, distribute malicious code, interfere with services, or bypass access controls.
- Do not share private portal credentials or access links with unauthorized people.
- Do not upload or disclose another person’s confidential information, personal data, or intellectual property without permission, including through AI tools.
- Do not record or publish other participants’ images, voices, or work without the permissions required by law and any applicable program rules.
We may restrict access when reasonably necessary to address a material breach, protect people or systems, or comply with law. Where practical, we will explain the issue and provide an opportunity to resolve it. Restrictions do not automatically forfeit refund rights or override an enrollment agreement. Nothing in these terms restricts honest reviews, lawful complaints, or reports to public authorities.
6. Learning materials and your work
Our website, branding, and original teaching materials belong to us or their respective owners. You may access and use materials made available to you for your personal learning and apply the skills you learn in your own work. Unless a separate license allows it, do not resell, republish, or distribute our materials or imply our endorsement without permission. Statutory exceptions, including fair use, remain available.
You retain any ownership rights you have in your original projects and submissions. By submitting work for teaching, feedback, or program participation, you give us a nonexclusive permission to use and display it only as reasonably needed for those purposes. These terms do not transfer ownership of your work or authorize its use in public marketing. Third-party materials and AI outputs may be subject to separate rights and license restrictions.
7. Third-party services and personal information
Our services may link to or use external tools, payment services, scheduling services, and content. Those providers have their own terms and privacy practices. We do not control their availability, security, or outputs. Review their policies before using them or sharing information.
Provide only information you are authorized to share. Our Privacy Policy explains how we handle personal information. These terms do not grant blanket consent to marketing, recording, or processing personal information.
8. Text messaging and mobile privacy
With your consent, General Fractal Corporation, operating as Fractal Accelerator, may send SMS or MMS messages to the mobile number you provide about your inquiry, application, appointments, enrollment, and class updates. If you separately opt in to promotional messages, those messages may include information about upcoming cohorts, events, and offers. Messages may be sent using automated technology. We will send only the types of messages covered by your consent.
SMS consent is separate from agreement to these terms. Simply visiting this website, accepting these terms, or providing a phone number does not enroll you in promotional texts. Consent to receive text messages is not a condition of applying, purchasing, or participating in the program. You may contact us by email instead.
Message frequency varies based on your interactions with us and the messaging program you join. Message and data rates may apply under your mobile plan. Carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed.
To opt out: reply STOP to a text from us, or email admin@fractalnyc.com with the mobile number you want removed. We also honor other reasonable requests to stop messages. We will process your request as soon as practicable and within the time required by law. You may receive one non-promotional message confirming your opt-out; no further messages requiring consent will be sent unless you opt in again.
For help: reply HELP or email admin@fractalnyc.com. Please tell us if your number changes or is no longer yours. Only opt in using a number you own or are authorized to use.
Mobile privacy: we use mobile numbers, messaging consent records, and message history to provide and support the messaging program, manage preferences, and meet legal obligations. We do not sell mobile information or share it with third parties or affiliates for their own marketing or promotional purposes. SMS opt-in data and consent are not shared for those purposes. We may share the information with service providers that help operate our messaging program, subject to appropriate confidentiality and use restrictions, or where legally required.
9. Website availability and limits of liability
We work to keep our website and resources useful and available, but cannot promise uninterrupted access or that every resource will be free of errors. To the extent permitted by law, website content and free learning resources are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This does not limit our express commitments for paid services.
To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of the website or free learning resources. This exclusion does not apply to fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded. Nothing in this section limits mandatory consumer protections, refund rights, or obligations under a separate enrollment agreement.
10. Changes and general provisions
We may revise these terms and will update the date on this page. Changes apply prospectively from publication. Where required, we will provide additional notice or obtain consent. Changes do not retroactively alter an existing enrollment agreement or remove accrued rights.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive it. These terms do not require arbitration or waive your right to bring a claim in a court with jurisdiction.
