Privacy Policy

1. Information we collect

• Information you provide: your name, email address, phone number, application and scheduling details, and information you include in messages to us.
• Program information: enrollment and payment status, coursework, assessment answers and results, and other information you submit while participating in the program or using the student portal.
• Payment information: payments are processed by Stripe. We receive transaction and payment-status information; full card details are submitted to the payment processor rather than through our website forms.
• Technical and usage information: IP address, browser and device information, pages visited, clicks, referring pages, campaign identifiers, and interactions with forms and learning tools. Cookies and similar technologies may associate visits and activity with a browser or user.

We receive information directly from you, through your use of our services, and from providers that help us manage applications, scheduling, payments, and communications. Please do not submit sensitive information or someone else’s personal information unless it is necessary and you are authorized to do so.

2. How we use information

We use information to respond to inquiries, provide requested materials, review applications, schedule appointments, manage enrollment and payments, deliver educational services, provide feedback and support, and communicate program updates. We also use it to understand website use and campaign performance, improve our services, prevent abuse, maintain security, and comply with legal obligations.

Where permitted by law and consistent with your choices, we may send information about our programs and events. Promotional text messages require a separate opt-in as described below. This policy is a disclosure of our practices, not a request for blanket consent.

3. Service providers and disclosures

We disclose information to providers that help operate our services. These include Vercel for website hosting, HubSpot for contact and application management, PostHog for website analytics, Dub for campaign attribution, Stripe for payments, Cal.com for scheduling, and Convex for assessment records. Email, messaging, and other program tools may also process information needed to provide their services.

For example, application and syllabus-request forms send contact information to HubSpot. When analytics is enabled, submitted name, email, and phone information may be associated with website activity in PostHog. Dub may receive lead and payment-conversion information to connect those events with campaign links.

We may also disclose information when required by law or legal process, to protect rights and safety or investigate misuse, to professional advisers, or in connection with a merger, acquisition, or transfer of our business, subject to applicable legal protections. Other disclosures may occur at your direction or with your consent. The restrictions on mobile information in Section 5 apply to marketing-related disclosures.

4. Cookies, analytics, and external content

Our website uses browser storage to retain progress in some learning tools. When enabled, PostHog uses cookies or similar storage to understand visits and interactions, and Dub uses a campaign cookie to attribute applications and payments. Analytics can connect activity across visits and, after you submit a form, with your contact information.

External fonts, embedded videos, and linked services may allow their providers to receive technical information such as your IP address and browser details. Those providers may collect information about activity over time and across websites under their own privacy policies. External services have their own terms and privacy practices, which you should review before using them.

You can manage or delete cookies and site storage through your browser settings. Blocking or clearing storage may affect functionality or erase saved learning progress; it does not delete information already held by us or our providers. Our website does not currently change its behavior in response to browser “Do Not Track” signals. If applicable law gives you additional tracking or opt-out rights, you can contact us to exercise them.

5. Text messages and mobile information

With your consent, we may text you about inquiries, applications, appointments, enrollment, and class updates. Promotional messages about cohorts, events, or offers require separate consent. Providing a phone number or accepting this policy does not enroll you in promotional texts, and consent to texting is not a condition of applying, purchasing, or participating.

We use mobile numbers, consent records, and message history to operate and support the messaging program, manage preferences, and meet legal obligations. We do not sell mobile information or share it with third parties or affiliates for their own marketing or promotional purposes. SMS opt-in data and consent are not shared for those purposes. We may share this information with providers that help operate the messaging program, subject to appropriate confidentiality and use restrictions, or where legally required.

Reply STOP to opt out or HELP for assistance, or contact admin@fractalnyc.com. We also honor other reasonable opt-out requests. Message frequency varies; message and data rates may apply. See our text messaging terms for more details.

6. Your choices and privacy requests

You can request access to, correction of, or deletion of your personal information by emailing admin@fractalnyc.com. Depending on where you live and which laws apply, you may have additional rights, including to receive a copy of your information, restrict or object to certain uses, withdraw consent, or opt out of certain disclosures. We will handle requests as required by applicable law.

We may need to verify your identity and clarify your request. Some information may need to be retained for legal, accounting, security, or other permitted reasons. Where applicable, you may use an authorized agent, appeal our response by contacting us, or complain to the relevant privacy authority. We will not discriminate against you for exercising applicable privacy rights.

To stop promotional emails, use the unsubscribe option in the message or contact us. You may still receive service-related communications needed to administer your enrollment, payments, or requests. For text-message preferences, see Section 5.

7. Retention and security

We retain information for as long as reasonably needed for the purposes described here, including providing the program, maintaining records, resolving disputes, and meeting legal obligations. Retention depends on the type of information, our relationship with you, and applicable requirements. We may retain limited records of communication preferences to honor opt-out requests.

No method of storage or transmission is completely secure. Please use care when sharing information and contact us if you believe information associated with our services has been compromised.

8. Where information is processed

We operate in the United States. We and our providers may process information in the United States and other countries where we or they operate. Privacy laws in those locations may differ from those where you live. Any safeguards or transfer requirements that apply under law continue to apply.

9. Children’s privacy

Our services are intended for adult learners and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us so we can investigate and take appropriate steps, including deletion where required.

10. Updates and contact

We may update this policy as our practices change. We will post the revised policy with an updated effective date and provide additional notice or obtain consent where required by law.
